Terms of Service & Refund Policy

By accessing or using the Scarlet Lux Meme-O-Matic Studio app ("the App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify active Pro subscribers of material changes via email.

You must be at least 18 years of age to use the App. By using the Service, you represent that you are 18+ and accessing it for personal, non-commercial entertainment purposes (including creating and sharing satirical memes).

The App functions as a creative tool for generating and editing memes, including political satire, gaffes, and commentary. All communications and user-generated content are treated as private interactions between users of this service. We reserve the right to revoke access at any time for any reason or no reason.

The App offers a Free tier and a Pro subscription tier. Pro is billed monthly ($9.99/month) or annually ($79.99/year) via Stripe. You may cancel anytime in your account settings. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.

If you purchase a Pro subscription through the Android app via Google Play, your subscription is subject to Google Play's billing terms and policies in addition to these Terms.

• Payments are processed by Google Play, not directly by MEGATRONICSMEDIA LLC.
• You may manage or cancel your subscription at any time through your Google Play account settings.
• Refunds for Google Play purchases are governed by Google Play's refund policy. To request a refund via Google, visit play.google.com/store/account.
• AI generation credits consumed through the Android app are non-refundable once used, regardless of platform.
• For support or billing questions related to your Android purchase, contact us at support@scarlet-lux-machine.com.

14-Day Refund Window: Full refund requests for initial Pro purchases (via Stripe/web) are accepted within 14 days of purchase if you are not satisfied.

After 14 days, all sales are final.

AI Generation Credits: Non-refundable once consumed. Refunds may be reduced or denied if AI credits were used during the period.

Renewals: No refunds on automatic renewals. Cancel before the renewal date.

Annual Plans: Prorated refunds possible only within 14 days of original purchase.

Abuse Prevention: We may deny refunds for patterns such as subscribe → exhaust credits → refund. Repeat abusers may be banned.

You agree not to use the App to:

• Harass, threaten, impersonate, or intimidate any person.
• Create or share content that is unlawful, hateful, harmful, racist, threatening, abusive, harassing, tortious, defamatory, obscene, libelous, or invasive of privacy.
• Promote, recruit for, or organize real-world political groups or illegal activities.
• Violate any intellectual property, privacy, or other laws.
• Spam, send unsolicited advertising, or engage in commercial solicitation.
• Attempt to hack, scrape, or automatically extract data from the App.

We encourage satirical and transformative political memes (gaffes, flubs, hot potatoes) but you are solely responsible for the content you create and share. We do not endorse any user content.

Your Content: You retain ownership of memes and images you create. By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, display, and use your content solely to operate and improve the Service (e.g., gallery features, moderation).

AI Outputs: AI-generated images are provided "as is." You are responsible for ensuring your use complies with all laws. We make no ownership claim over AI outputs.

Fair Use Notice: The App includes templates and images of public figures and events for satirical, commentary, and parody purposes under the fair use doctrine. However, commercial exploitation outside the App may require additional clearances. You agree not to create content that infringes third-party rights.

We respect copyright and will respond to valid DMCA takedown notices. Contact: support@scarletlux.com (include "DMCA" in subject).

Under 47 U.S.C. § 230, MEGATRONICSMEDIA LLC is an interactive computer service and is not liable for user-generated content provided by others. We do not act as the publisher or speaker of such content.

The App and all AI features are provided "AS IS" and "AS AVAILABLE" without any warranties. We do not guarantee error-free operation, uninterrupted access, accurate or non-offensive AI outputs, or specific results. AI content is unpredictable and may reflect biases in training data. Use at your own risk. We are not liable for any memes or outputs you create or share.

To the maximum extent permitted by law, our total liability for any claim shall not exceed the amount you paid us in the 30 days before the claim. We are not liable for indirect, incidental, consequential, punitive, or special damages, including lost profits or content misuse.

You agree to defend, indemnify, and hold harmless MEGATRONICSMEDIA LLC, its owners, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from: (i) your use of the App; (ii) your User Content; (iii) your violation of these Terms; or (iv) any claim that your content infringes third-party rights.

We may modify or discontinue features (including AI models or credit systems) at any time without liability.

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Sacramento County, California. You agree to a class action waiver and that any claims must be brought individually.
